But how much can you give before there are tax implications? And how do the rules differ if you\u2019re giving gifts to your directors?<\/p>\n\n\n\n<p>The good news is that you can give gifts that don\u2019t exceed \u00a350 in value to your employees without any tax or National Insurance (NI) charges arising \u2013 as long as you follow HMRC\u2019s rules. The cost of this is also tax-deductible by the company.<\/p>\n\n\n\n<p><strong>Making use of the Trivial Benefits scheme<\/strong><\/p>\n\n\n\n<p>As part of HM Revenue &amp; Customs\u2019 (HMRC\u2019s)&nbsp;<a href=\"https:\/\/www.gov.uk\/expenses-and-benefits-trivial-benefits\" target=\"_blank\" rel=\"noreferrer noopener\">Trivial Benefits scheme<\/a>, you can give gifts to your employees to mark birthdays, weddings or just \u2018because\u2019, all without attracting any tax charges. Owners can also benefit from the same Trivial Benefits scheme.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Trivial benefits can be provided to employees without any adverse tax or NI implications, and with no need to report them on a&nbsp;<a href=\"https:\/\/www.gov.uk\/paye-forms-p45-p60-p11d\/p11d\" target=\"_blank\" rel=\"noreferrer noopener\">P11D form<\/a>&nbsp;\u2013 the HMRC form used to report any \u2018benefits in kind\u2019 that you\u2019ve provided to an employee.<\/li>\n\n\n\n<li>To qualify, gifts can\u2019t be a reward for services, can\u2019t be cash or a cash voucher, can\u2019t be contractual, and the cost mustn\u2019t exceed \u00a350 per gift.<\/li>\n\n\n\n<li>For directors of close companies, the total can\u2019t exceed \u00a3300 in any year. Although not limited for other employees, if it was a regular gift then it\u2019s likely to be treated as a reward for services \u2013 which would then have tax implications.<\/li>\n\n\n\n<li>If over the course of a year, a director awarded themselves 6 x \u00a350 gift cards (maxing out the \u00a3300 cap) as a higher-rate taxpayer they could save around \u00a3126 in tax and NI compared with a \u00a3300 salary. The company would also save about \u00a341 in NI.<\/li>\n\n\n\n<li>Gift cards are fine as long as they aren\u2019t pre-loaded debit cards that can be used to withdraw cash \u2013 remember you can\u2019t give cash as a gift.<\/li>\n<\/ul>\n\n\n\n<p><strong>Let\u2019s look at an example of these rules in practice:<\/strong><\/p>\n\n\n\n<p>If an employee is given a bottle of wine for hitting a sales target, that would be taxable. If they were given the wine because it\u2019s their birthday, as long as it was below \u00a350 it would be within the exemption.
